The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 and Section 303(2) of BNS in Crime No.464 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that he along with other accused, was illegally quarrying granite soil and rocks from the land alleged to belong to the Ex-Servicemen, without obtaining any valid licence or permission from the competent authority. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is only the owner of the vehicle and that he is an innocent person who has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is not merely the owner of the vehicle and that he was actively involved in illegally quarrying sand and rocks from lands belonging to private parties, without their knowledge or consent. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the allegations relating to illegal quarrying the sand and the resultant ecological damage, this Court is not inclined to grant anticipatory bail to the petitioner.
