Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent herein to consider the petitioner's representation dated 13.10.2025 direction to direct the respondents to reinstate the petitioner in service from the date of dismissal from service with consequential benefits following by the circular of DGP dated 06.12.2007.

This writ petition has been filed for direction to the 2nd respondent to consider the petitioner's representation dated 13.10.2025 seeking to reinstate her in service from the date of dismissal from service with consequential benefits following by the circular of DGP dated 06.12.2007.

Heard, the learned counsel appearing on either side. 3.

The petitioner was appointed as Constable in the year 2003. Thereafter due to her illness, she did not report for duty. As such, disciplinary proceedings was initiated against her. The charges were found proved and she was removed from service in the year 2009. After period of 16 years, she submitted representation seeking reinstatement into service on the ground that the service of a constable cannot be terminated on the ground of desertion.

Admittedly, the petitioner was terminated from service in the year 2009 and after period of 16 years, she submitted representation seeking reinstatement into service, which cannot be considered. Therefore, this writ petition is liable to be dismissed. 5.

Accordingly, this writ petition is dismissed. There shall be no order as to costs.
