O R D E R

This writ petition has been filed to direct the respondent to pay difference in leave salary and difference in gratuity with 10% interest as per 15th wage settlement dated 29.05.2025 to the petitioner.

2. The petitioner joined the service of the respondent Corporation in the year 1990 and he was retired from service in the year 2023. After retirement, the respondents settled the terminal benefits based on salary paid on 25.08.2025. 15th wage settlement was arrived on 29.05.2025 and wage revision was given with effect from 01.09.2023 and monetary benefit was given with effect from 01.01.2022. However, difference in leave salary and difference in gratuity were not settled till date based on revised pay. Hence, the petitioner sent a representation on 17.09.2025 to the respondents to pay difference in leave salary and difference in gratuity with interest based on 15th wage settlement. Since the same was not considered, the present writ petition has been filed.

3. The learned counsel appearing for the petitioner would submit that it would suffice, if the respondents are directed to dispose of the representation of the petitioner dated 17.09.2025 on merits and in accordance with law, within a specified period.

4. The learned Standing Counsel appearing for the respondent submits that if 15th wage settlement dated 29.05.2025 is applicable to the petitioner, the same will be extended in favour of the petitioner.

5. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

6. In view of the limited request made by the learned counsel appearing for the petiitoner, this Court, without going into the merits of the case, directs the respondent to consider the representation of the petitioner dated 17.09.2025 and if the petitioner is eligible under 15th Wage Settlement, the said benefit shall be extended in favour of the petitioner.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
