ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.02.2024, for the alleged offence punishable under Sections 8(c) r/w. 20(b)(ii) (c), 23, 27, 28 and 29 of the NDPS Act, in F.No.48/1/04/2024-NCB/MDS on the file of the respondent police, seeks bail.

2. This is a successive bail application filed by the petitioner seeking bail on medical grounds. This Court, for the purpose of assessing the medical condition of the petitioner, has directed the medical board to give an opinion after conducting an elaborate examination. Accordingly, the medical board has issued the following report after conducting various tests.

3. The above report of the board reveals that though the petitioner is advised for surgical management and it is stated that the government hospital is also having management and she is not willing to go for surgery, she wants to continue her medical management with drugs. That being the case, and it is also stated that the government hospital has the facility to handle her medical health condition, hence this Court is of the view that though she is having some medical ailment, the petitioner could not seek the same as a valid ground for bail. Hence, this Court is not inclined to grant bail. Accordingly, this petition is dismissed.
