ORDER

This Writ Petition (Criminal) has been filed seeking to direct the respondents to issue a 'No Objection Certificate' to run the business of Massage Parlour and SPA (including Physiotherapy) in the name and style of Aurora 1 / 5

Physio Wellness at No.123/5, 1st Floor, Perundurai Road, Thindal, Erode-638 012, considering the petitioner's representation dated 30.10.2025.

Learned counsel for the petitioner submitted that Rule 299(1) of the Tamil Nadu Urban Local Bodies Rules, 2023 mandates that the trades and businesses such as spa and massage parlour shall not operate without obtaining a license from the Commissioner and also the proviso to rule 299(6) of the Tamil Nadu Urban Local Bodies Rules, 2023 mandates that NOC from the jurisdictional Commissioner of Police or Superintendent of Police, as the case may be, is a precondition for issuing such license. Therefore, obtaining a noobjection certificate from the Superintendent of Police or Commissioner of Police is necessary to obtain a trade licence from the City Corporation.

3. Mr.S.Santhosh, learned Government Advocate (Criminal Side) would submit that the representation of the petitioner dated 30.10.2025 was received by the respondents and the same will be disposed of within a period of four weeks.

4. Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, this Court is of the view that this Court, in similar circumstances, following the ratio laid down by this court in 2 / 5

the judgment in Masti Health and Beauty Private limited & Others V. The Commissioner of Police, Chennai City reported in 2015(1) MLJ 308, disposed of the Writ Petition in W.P.No.9380 of 2016 vide order dated 14.03.2016, directing the respondent police to comply with the directions/conditions imposed in paragraph 67 of the said judgment and further making it clear that the petitioner therein, under the guise of carrying on business activity, shall not indulge in any unlawful or illegal activities detrimental to law and order or public order.

In the light of the aforesaid order, this Writ Petition (Criminal) is disposed of directing the respondents 1 and 2 to consider the representation of the petitioner dated 30.10.2025 and pass orders within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that after issuance of No Objection Certificate, the petitioner, under the guise of carrying on business activity, shall not indulge in any unlawful or illegal activities detrimental to law and order or public order.
