The petitioner, who was arrested and remanded to judicial custody on 31.10.2025, for the offence punishable under Sections 310(2) of BNS in Crime No.341 of 2025, registered on the file of the respondent, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joining hands with other accused hatched conspiracy to rob money under the pretext of sale of old gold for lower price, had cheated the defacto complainant to the tune of Rs.25,00,000/-. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that investigation in this case is pending and further submitted that the petitioner also actively participated in the conspiracy and the stolen money not been recovered. Hence, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the fact that the investigation is pending and the stolen money has not been recovered and also the fact that the petitioner also actively participated in the conspiracy, this Court is not inclined to grant bail to the petitioner. 2/4
