This Civil Miscellaneous Petition has been filed to condone the delay of 167 days in filing the second appeal against the judgment and decree dated 21.01.2025 passed in A.S.No.64 of 2018 on the file of the III Additional District Judge, Salem reversing the judgment and decree dated 19.09.2017 made in O.S.No.3 of 2013 on the file of the Additional Subordinate Judge No.1, Salem.

2. Mr.P.Mani, learned counsel appearing for respondents 1 to 4 and Mr.Ponnusamy, learned counsel appearing for the fifth respondent have no serious objection in allowing this petition.

3. Considering the reasons stated in the affidavit filed in support of this petition and as no serious objections expressed by the learned counsel first respondents, delay is condoned and this Civil Miscellaneous Petition is Ordered.
