ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.06.2025 for the offences punishable under Sections 5(l), 5(m), 6 of POCSO Act and Sections 127(2), 332(b), 65(2), 76 of BNS, in Crime No.21 of 2025, registered on the file of the respondent police, seeks bail.

The allegation against this petitioner is that, taking advantage of loneliness of the victim girl aged about 13 years, he had committed a penetrative sexual assault and thereafter while he was staying in a house, the neighbours and others witnessed the same and immediately he was caught redhanded and produced before the police. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is falsely implicated in this case and he is in judicial custody since 27.06.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that it is the case of penetrative sexual assault committed by the accused herein, investigation is 2/4

concluded, final report filed, the case is pending fro framing of charges on 04.12.2025 and opposed for grant of bail to the petitioner.

I have also gone through the FIR, it revealed that this petitioner is aged about 62 years and entered into the victim girl's house and after locking the door he committed penetrative sexual assault to the victim girl, some of the persons came there seen him inside the house and immediately the petitioner got redhanded, I am of the view that the petitioner is not entitled to bail at the stage of furnishing the copies and there is likelihood, if the petitioner is released on bail he will tamper the evidence, hence this Court is not inclined to grant bail to the petitioner at this stage.
