Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of mandamus to direct the 3rd respondent (Revenue Divisional officer) to consider and conduct an enquiry based on the petitioner's representation dated 2.7.2025 and dispose of the same within a time frame as may be fixed by this court; consequently direct the 4th to 6th respondents to refrain from mutating or altering the patta in respect of the property subjected to Sr.No.77/1F with an extent of 51.00 Ares situated at Vadchettiyanthal village, Sankarapuram Taluk, Kallakurichi District until final disposal of petitioner's representation.

ORDER

This writ petition has been filed seeking for a direction to the third respondent to delete the name of the 7th respondent in the patta for the property morefully described in the prayer to this writ petition, based on the petitioner's representation dated 02.07.2025, within a time frame to be fixed by this Court.

2. The petitioner claims that erroneously, the 7th respondent's name has been included in the joint patta for the subject property. The petitioner seeks for deletion of the 7th respondent's name in the said patta. He has given a representation dated 02.07.2025 to the third respondent for deletion of the 7th respondent's name for the subject property. Since the said representation has not been considered till date, he has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 6. Since no adverse orders are passed against the 7th respondent, notice to the 7th respondent in this writ petition is dispensed with.

4. No prejudice will be caused to the official respondents, if the aforesaid representation of the petitioner is considered, on merits and in accordance with law, after hearing the objections if any from the 7th respondent as well as any other party whom the official respondents deem fit to enquire, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the third respondent to pass final orders on the petitioner's representation dated 02.07.2025 seeking for deletion of the 7th respondent's name in the joint patta for the subject property, after hearing the objections if any from the 7th respondent as well as any other party whom the third respondent deems fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. No Costs.
