India, pleased to issue a Writ of Certiorarified Mandamus, by calling for the entire records on the file of the 3 rd respondent in pursuant of the "REFUSAL CHECK SLIP DATED 04.11.2025 BEARING NO.RFL / ACHARAPAKKAM /135/2025" and quash the same, consequently directing the 3 rd respondent to register the settlement deed dated 04.11.2025 executed in favour of the petitioner by her husband Mr.N.Ramadoss. ORDER
A settlement deed dated 04.11.2025 was presented by the petitioner before the third respondent for registration. The said instrument was not 2/7
registered and refusal check slip dated 04.11.2025 was issued. The said refusal check slip is challenged herein.
2. Learned counsel for the petitioner submits that the reason mentioned therein is that the index was not entered correctly. He states that the obligation to maintain the index is imposed on the registering officer and not on the petitioner.
3. Learned Special Government Pleader accepts notice for all the respondents.
4. On perusal of the impugned refusal check slip, the reason mentioned therein is "index was not mentioned correctly". No further particulars are provided therein. It is unclear as to the nature of the index referred to therein and the petitioner's role in relation thereto. Being 3/7
unreasoned, the order cannot be sustained and hereby set aside.
5. As a corollary, the Sub Registrar is directed to re-consider the matter and take a decision within two weeks from the date of re-presentation of the settlement deed after providing a reasonable opportunity to the petitioner.
