ORDER
The petitioner's land was acquired under the Tamil Nadu Highways Act, 2001 (the Highways Act). The award was issued on 31.05.2025. The petitioner asserts that the award was received only on 22.08.2025. After submitting representation dated 25.08.2025 seeking enhanced compensation, the present writ petition has been filed.
2. Learned counsel for the petitioner relies upon earlier order dated 13.10.2025 in W.P.No.38786 of 2025. He submits that the petitioner is in the same position as the petitioner therein.
3. Mr.P.Sathish, learned Additional Government Pleader, accepts notice
for the respondents.
4. Under Section 20 of the Highways Act, the land owner has the right to seek higher compensation by making a claim in that regard within sixty days from the date of the decision. As held in the earlier order of this Court dated 13.10.2025 in W.P.No.38786 of 2025, the said 60 day period would run from the date on which the person concerned has knowledge of the decision.
5. Therefore, this writ petition stands disposed of by directing the second respondent to consider the petitioner's representation dated 25.08.2025 for enhanced compensation by considering the request for reference in respect thereof. After providing a reasonable opportunity to the petitioner, a decision shall be taken within a period of six weeks from the date of receipt of a copy of this order. There will be no order as to costs.
