Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 4th & 5th Respondents to take action and consider and pass orders on the Petitioner's representation dated 30.07.2025 by vide forwarding Letter in O.Mu.No.C3/9355/2025 dated 13.08.2025 by the 2nd Respondent and also by vide forwarding Letter in O.Mu. No. C3/11871/2025 17.10.2025 by the 1st Respondent and also further forwarded letter of the 3rd Respondent in Na.Ka. No. A4/4529/2025 dated 18.10.2025 and dispose of the same within the timeframe that may fix by this Hon'ble Court.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) In response to the allegations made in the petition, a counter has been filed by fourth respondent which clearly reveals that encroachments have been found and action has been initiated. As the lands come under the control of the Block Development Officer, Thimiri, Form I (Encroachers list) has been forwarded to the Block
Development Officer, Thimiri, by the Tahsildar, Kalavai Taluk on 10.12.2025 for taking necessary action, in accordance with law.
2. Learned State counsel would submit that based on the said report/communication, the Block Development Officer has issued notice under Section 131 of the Panchayats Act to the encroachers on 12.12.2025 and the proceedings are pending.
3. In view of the said disclosure, we are not inclined to keep this petition pending, but to dispose of with direction to the official respondents to conclude the proceedings and remove the encroachers within outer limit of three months.
