Mrs.Inthu Karunakaran, Government Counsel for R1 to R5 Mr.Prasanth for R10 and R11 Order Challenge in this writ petition is to the order of the 5th respondent in Patta bearing No.2025/0153/02/016709TR dated 18.04.2025 along with the copy of the Survey Plan issued by the 5th respondent for the property situated at B6, GoCH colony, 11th Cross street, Besant Nagar, Chennai-600 090, comprised in T.S.No.08/10 of Block 40 of Urur Village measuring an extent of 5711 sq.ft. issued in favour of the respondents 6 to 12 and to quash the same, since the same is illegal and contrary to Law.
2. The petitioner is a co-owner of the subject property and the respondents 6 to 12, in a clandestine and manipulative manner, obtained patta bearing No.2025/153/02/016709TR dated 18.04.2025 from the 5th respondent, wherein the boundaries of Block B6 have been shown with a protrusion on the South Eastern Side, encroaching Block A5 to an extent of approximately 315.75 Sq.Ft. Based on the said erroneous patta, the respondents 6 to 12, in collusion with a builder, obtained planning permission from CMDA dated 27.06.2025 for
construction of a Multi Storeyed residential building. Aggrieved by the said planning permission, the petitioner and other co-owners have filed W.P.No.34212 of 2025, wherein notice was ordered to the respondents. The petitioner also submitted a detailed representation dated 18.07.2025 to the 5th respondent seeking rectification of the patta error, however, no action has been taken so far. Hence, the present writ petition.
3. In reply, the learned Government Counsel appearing for the respondents would submit that the petitioner's representation dated 18.07.2025 will be disposed of by the 4th respondent within a period of twelve weeks.
4. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record.
5. In view of the above, this Court directs the 4th respondent to consider the petitioner's representation dated 18.07.2025 on its own merits, after issuing notice to the petitioner and private respondents and dispose of the same in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.
6. With the above directions, this writ petition is disposed of. No costs. Consequently, WMP.No.52744 of 2025 is closed and WMP.No.52743 of 2025 is ordered.
