ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the representation made by the petitioner on 08.09.2025, wherein, the petitioner is seeking for the cancellation of patta that has been issued in the name of the 3 rd and 4 th respondents with respect to the subject property.

2.Heard Mr.P.M.Jayachandran, learned counsel appearing on behalf of the petitioner and Mr.P.Ganesan, learned Government Advocate appearing on

3/7 behalf of the respondents 1 to 4.

3.In the considered view of this Court, if the petitioner is claiming right and title over the subject property and the patta has been issued in the name of the 3 rd and 4 th respondents, the petitioner has to necessarily file an appeal before the Revenue Divisional Officer, Krishnagiri and seek for the cancellation of the patta. However, the petitioner has given a representation to the District Revenue Officer who is not the appellate authority.

4.In view of the above, liberty is granted to the petitioner to submit a representation before the Revenue Divisional Officer, Krishnagiri along with all the relevant documents and also a copy of this order. On receipt of the same, the Revenue Divisional Officer, Krishnagiri shall conduct an enquiry after affording an opportunity to the petitioner and respondents 3 and 4 and pass final orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of the appeal from the petitioner.
