ORDER
The petitioner, who were arrested and remanded to judicial custody on 18.06.2025 for the offences punishable under Sections 5(l), 5(n), 5(j)(ii) r/w 6 of POCSO Act, 2012, in Crime No.21 of 2025, registered on the file of the respondent police, seeks bail.
2. The allegation against this petitioner is that, this petitioner is the sister's husband of the victim girl aged about 13 years and taking advantage of loneliness he committed aggravated penetrative sexual assault, which results causing pregnancy to her. Hence the complaint was lodged.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner is in judicial custody since 18.06.2025; and that the petitioner is ready to abide by any stringent conditions. He further submitted that the pregnancy of the victim girl is also terminated and the case is also pending for trial. Hence for the purpose of preparation of trial and he prays to grant bail to the petitioner. 2/5
4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that investigation is concluded, final report filed and pending as Spl.S.C.No.162 of 2025 and posted for framing of charges and opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case, that the petitioner has committed aggravated penetrative sexual assault to the victim girl aged about 13 years, the case is pending for framing of charges, if the bail is granted to the petitioner he will tamper the witness, this Court is not inclined to grant bail to the petitioner at this stage.
