The petitioner, who apprehend arrest for the alleged offence under Sections 302(2), 326(a) of BNS in Crime No.204 of 2025, on the file of the respondent police seek anticipatory bail.

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS in Crime No.204 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that based on the secret information, the respondent police went to the scene of occurrence and found that the petitioner along with other accused had illegally loaded 11⁄2 units of gravel sand from the lake and transported the same by using JCB and tractors. Hence, the case.

3. The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and submitted that earlier this court has dismissed the petitioner's anticipatory bail petitions vide order dated 14.11.2025 in Crl.OP.No.31152 of 2025 on the following reasons:

" Considering the facts and circumstances of the case, the nature and gravity of the offence made by the learned counsel on either side and since the petitioner had alleged quarried and transported gravel sand illegally causing environmental damage, this Court is not inclined to grant antipatory bail to the petitioner"

4. Considering the facts nature and gravity of offence and there is no change of circumstances after the dismissal of petitioner's bail petition and hence, this Court is not reconsider the earlier order .

5. Accordingly, this Criminal Original Petition stands dismissed.
