O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(C), 4(1)(A) of the Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.156 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2.

The case of the prosecution is that on 12.11.2025 at about 18:00 hours, while the respondent police conducted a prohibition raid near Kamarajar Nagar, they found that the petitioner herein was involved in illegal possession of 29 numbers of liquor bottles (each 180 ml) for the purpose of illegal sales for higher price; that on seeing the police, the petitioner fled away from the spot. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner has three previous cases of similar nature; and that the investigation of this case is pending.

Considering the submissions made on both sides, facts and circumstances of this case, gravity of offence, the previous antecedents of the petitioner and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 25.11.2025 stn 3/4
