This writ petition has been filed for direction to the respondents to to pay the difference in payment of leave salary together with interest @ 6% per annum in terms of the 13th Wage settlement and by following the government letter No.1706/c1/2023-1 dated 25.05.2023 to the petitioner within a time frame.

Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner was an employee of the respondent Corporation and he retired from service on 31.10.2016, on attaining the age of superannuation. His terminal benefits have been settled through installments on various dates.

Thereafter, a settlement was entered into between the Union and the Management on 04.01.2018. But it was made applicable with effect from 01.09.2016. Therefore, the petitioner was also entitled to the benefit under the said settlement, dated 04.01.2018. But his terminal benefits were settled without reference to the terms of the settlement.
Therefore, the petitioner is entitled not only to the difference in benefits, but also interest thereon.

This stand of the petitioner cannot be disputed. Therefore, the respondent is directed to pay difference in leave salary, difference in gratuity and pension arrears as per the wage settlement dated 04.01.2018. Those amounts shall be paid within period of six weeks from the date of receipt of a copy of this order. The respondent has to make the differential payment with 6% interest per annum to be computed from the date of the petitioners' retirement till the date of payment. 6.
With the above said observations, the Writ Petition stands disposed of. No costs.
