(Order of the Court was made by the Hon'ble Chief Justice) The allegation is that while raising construction, the private respondent has encroached upon the petitioner's own land. When that is the allegation, remedy lies in filing a civil suit and not to approach the Writ Court.

Petition is dismissed with liberty to file a suit. There shall be no order as to costs.
