ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.11.2023 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) & 25 and 29(1) of NDPS Act, 1985 in Crime No.34 of 2023, registered on the file of the respondent police, seeks bail.

2.This Court has earlier dismissed the bail application of the petitioner

four times, and this is the fifth bail application. 3.The learned counsel for the petitioner submitted that the petitioner has been in incarceration for a long period and the trial is also not yet completed. Hence, he prayed for the grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent police reported that out of eight witnesses, two have already been examined, and this is a case involving transportation of 100.500 kgs of Ganja. If the petitioner is released on bail, there is a likelihood that he will indulge in similar offences, and there is no ground made out to satisfy under Section 37 of NDPS Act. 5.Considering the fact that the trial is progressing and out of eight witnesses, two have already been examined, this is not a case of continuous incarceration without any trial process, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. 03-12-2025 gbi
