This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 02.04.2025, seeking bail in Crime No.51 of 2025 registered for the offence under Sections 8(c) r/w Section 20(b)(ii)(c), of NDPS Act, 1985.

2. The allegation against the petitioner is that the petitioner was found in possession of 31 kgs of ganja. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is in custody from 02.04.2025 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the contraband seized is a commercial quantity. Hence, he strongly opposed the grant of bail to the petitioners.

Considering the quantity of the contraband seized from the petitioner is a commercial quantity and rigours of Section 37 of NDPS Act is applicable to this case and no grounds were made out for satisfying twin conditions of Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioners with certain conditions:
