ORDER

This Writ Petition (Criminal) has been filed praying to issue a Writ of Mandamus to direct the respondents 1 to 3 to grant police protection to the petitioner, his family and to his property as per his representation dated 08.10.2025.

The case of the petitioner is that he has been residing with his family in Old Survey No.845, Now T.S.No.1, Ward B, Block No.28, Ranipet, Ranipet District, having an extent of 2016 sq.ft., indexed with New Door No.22/67, Old Door No.13/37, South Railway Road, Ranipet, for a period of 40 years. According to the petitioner, in the year 2019, in the month of November, adjacent inhabitants viz., Pramila and Geetha, restrained him from his peaceful enjoyment and possession of the above mentioned property and they restrained the ingress and egress to his property. The petitioner, therefore, gave a representation to the 3rd respondent on 20.11.2019. The 3rd respondent enquired 2 / 5

into the matter and registered a case in CSR.No.1230 of 2019. It is further averred that the petitioner gave a representation to the Revenue Authorities to grant a free house site patta by considering his long possession of the above said land and the said representation is pending for consideration.

3. According to the petitioner, the nearby residents viz., Pramila, Viswanathan and Selvam are interfering with his peaceful possession and causing restraint to his ingress and egress. Hence, on 06.09.2025, the petitioner lodged a complaint with the 3rd respondent. But, there has been no progress in the said complaint. Therefore, the present W.P.(Crl.) is filed before this court.

4. Learned Government Advocate (Criminal Side) would submit that the matter is pending in CSR.No.977 of 2025 and the entire dispute is of civil nature.

5. Heard both sides and perused the records.

6. The petitioner has already approached this court by way of filing W.P.No.4506 of 2023 seeking a direction to the respondents viz., (1) The District Collector, Ranipet District, (2) The Revenue Divisional Officer, 3 / 5

Ranipet, and (3) the Tahsildar, Walajah Taluk, Ranipet District, to consider his representation dated 28.12.2022. This court also by order dated 15.02.2023, directed the 3rd respondent-Tahilsar, Walajah Taluk, Ranipet to consider the petitioner's representation-cum-application dated 28.12.2022 and decide the same on merits. Hence, taking into consideration the facts of the case and the relief sought, the parties are relegated to the Civil Court to settle their disputes, by adducing suitable evidence.
