ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the first and second respondents to issue a No Objection Certificate/Clearance Certificate to the petitioner for renewal of his passport. 2.

Heard the learned counsel appearing for the petitioner and the learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents 1 and 2 and perused the materials available on record. 3.

The petitioner is an accused in Crime No.161 of 2023 registered for the offences punishable under Sections 147, 294(b), 323 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002. Pending investigation, the petitioner went to Dubai for his avocation. Prior to the expiry of his passport, the petitioner applied for its renewal before the Vice Consul (Passport), Consulate General of India, Dubai. However, during the police verification process, the police submitted a verification report stating that a

criminal case was pending against the petitioner. Therefore, the petitioner's application for renewal of his passport was not considered. In the meantime, his passport expired on 14.10.2025.

The learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents 1 and 2 submitted that the investigation in Crime No.161 of 2023 has been completed and a final report was filed. The same has been taken cognizance in C.C.No.218 of 2025 on the file the Judicial Magistrate, Sendurai, Ariyalur District, and the case is now pending for trial. 5.

Admittedly, the petitioner's passport has expired. In order to appear before the Trial and to attend the trial proceedings, the petitioner is required to travel to India.

In view of the above, the second respondent is directed to issue No Objection Certificate for the limited purpose of enabling the petitioner to renew his passport within a period of two weeks from the date of receipt of a copy of this order. It is made clear that, whenever the petitioner arrives in India, he shall, within two days of his arrival, report before the second respondent and surrender his passport. Thereafter, the petitioner shall co-operate with the trial proceedings before the Trial Court in C.C.No.218 of 2025.

With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
