O R D E R

The petitioner, who was arrested and remanded to judicial custody on 01.10.2025 for the alleged offence under Sections 126(2), 191(3), 109(1), 103(1) of BNS r/w 190 of BNS in Crime No.218 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joined hands with 8 other accused. Since there was an earlier incident which resulted in a quarrel between the deceased and one of the petitioners herein, on the date of occurrence, the petitioner and others waylaid the deceased and attacked him on his head indiscriminately using knives and committed murder. Hence the petitioner was arrested by the respondent police on 01.10.2025.

The learned counsel for the petitioner submitted that the petitioner is not having any bad antecedent and based on the confession statement of the co-accused, the petitioner is arrayed as an accused in this case. However, the petitioner is ready to abide by any condition imposed by this Court and he prayed to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and reported that the occurrence was taken place on 29.09.2025 and the petitioner was also arrested and the FIR has been registered. He further submitted that the investigation is pending and it is at the preliminary stage and all the accused were arrested and remanded to judicial custody. At this stage, if the bail is granted to the petitioner, he would hamper the witnesses and therefore, he opposed to grant bail to the petitioner. 2/4

5. Considering the fact that the petitioner has specifically attacked the deceased with a knife. Though it is stated that the petitioner has not had any previous case, since the investigation is pending at the preliminary stage and at this stage, if the bail is granted to the petitioner, he would hamper the witnesses, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. 24.11.2025 MSM To:
