O R D E R

The present Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.355 of 2025, pending on the file of the first respondent police.

The case of the prosecution is that the petitioners/accused induced the de facto complainant and her daughter, under the guise of obtaining patta for their land and received a sum of Rs.13.80 lakhs, cheating the de facto complainant and her daughter. Based on the complaint given by the de facto complainant, the first respondent registered a case in Crime No.355 of 2025 against the petitioners/accused for the offences under Sections 406, 420 and 506 (i) of IPC.

Learned counsel appearing for the petitioners submitted that the no such incident had taken place as alleged in the complaint and that the entire allegations are false. Hence, he prayed for quashing the First Information Report in Crime No.355 of 2025 pending against the petitioners.

Learned Government Advocate (Criminal Side) submitted that based on the complaint given by the de facto complainant, the present case came to be registered on 24.09.2025. He further submitted that at the 2/5

nascent stage of investigation, the petitioners approached this Court in Crl.O.P.No.27816 of 2025 seeking anticipatory bail and the same was dismissed by this Court vide order dated 22.10.2025. He reiterated that the investigation is at still at a preliminary stage and the case requires thorough investigation and therefore, this Court cannot interdict the same under Section 482 Cr.P.C. Hence, he objected for quashing the case against the petitioners.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that this Court had earlier dismissed the anticipatory bail application, observing that the petitioners had approached the victims, gained their trust and cheated them by collecting a huge amount and further considering that the investigation is at a preliminary stage, this Court does not find any merit in this petition to quash the First Information Report. 6.

Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is also closed. 12.12.2025 ham 3/5
