ORDER
The petitioner had executed a sale deed dated 25.09.2025 in favour of one Mr.T.G.Ganesh and presented the same for registration. The request for registration was rejected by citing an order issued in I.A.No.496 of 2016 in O.S.No.95 of 2016.

Learned counsel for the petitioner referred to the order in the above mentioned interim application and pointed out that the restriction operated only until disposal of C.M.P.No.2010 of 2015 in M.C.No.22 of 2015. He points out that C.M.P.No.2010 of 2015 was disposed of on 21.02.2015 and that M.C.No.3 of 2017 was dismissed on 10.03.2021. Therefore, he submits that there is no impediment at present for the registration of the instrument. 2/5
3. Learned Special Government Pleader accepts notice for both the respondents. He submits that the petitioner may be directed to submit an affidavit providing details regarding the disposal of C.M.P.No.2010 of 2015 and M.C.No.3 of 2016 and that fresh orders would be issued on that basis.
4. The refusal check slip draws reference to the interim order issued on 13.06.2017 in I.A.No.496 of 2016 in O.S.No.95 of 2016. From the operative paragraph thereof, it is evident that the said restriction was until disposal of C.M.P.No.2010 of 2015. The documents on record reveal that the said C.M.P was disposed of on 21.02.2015 and, indeed, even the M.C was dismissed on 10.03.2021. Therefore, the reason for refusal does not appear to be sustainable. The request of learned Special Government Pleader in this regard is, however, reasonable. Considering the aforesaid, this writ petition is disposed of on the following terms. (i) Impugned refusal check slip dated 25.09.2025 is set aside and the matter is remanded to the said registration for re-consideration. (ii) The petitioner shall submit an affidavit setting out particulars of the disposal of C.M.P.No.2010 of 2015 and M.C.No.3 of 2017. The 3/5
petitioner shall also state expressly as to whether an appeal has been filed against the same.
(iii) Within two weeks from the date of receipt of such affidavit, Sub Registrar shall pass orders on the request for registration. (iv) No costs.
