Prayer in W.P.No.46350 of 2025: Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the Respondents to permit the Petitioner to operate the Black Granite Quarry at Survey No.184/1B(P), over an extent of 2.53.50 Ha situated at Thatchampattu, Villupuram District, for the non-operative period of 4 years, 8 months and 1 day, due to the unlawful suspension order issued by the 2nd Respondent, which was subsequently declared as null and void vide Common Judgment and Decree dated 17.09.2018, passed by the City Civil Court, Chennai in OS No.6260 & 6261 of 2011.

O R D E R

These Writ Petitions have been filed seeking a direction to the respondents to permit the petitioner to operate Granite quarry in the subject properties in the light of the common judgement and decree dated 17.09.2018 in O.S.No.6260 & 6261 of 2011 on the file of the City Civil Court, Chennai

2. Mr.Stalin Abimanyu, learned Additional Government Pleader takes notice on behalf of the 1st respondent. As no adverse order is being passed against 2nd respondent, notice to the 2nd respondent is dispensed with. 2/6

3.It is the case of the petitioner that, pursuant to the cancellation and termination of Raising Cum Sale Agreement dated 03.03.2011 for operating the quarry in the subject properties, the petitioner was constrained to file suits in O.S.Nos.6260 & 6261 of 2011 on the file of the VII Assistant Judge, City Civil Court, Chennai seeking declaration of suspension and consequential termination as null and void. Though the suits were decreed in favour of the petitioner vide common Judgement dated 17.09.2018, the petitioner was not been allowed to operate the quarry for the non-operative period. Therefore, the petitioner submitted a representation dated 19.12.2018 to the respondents seeking permission to operate the quarry. Pursuant to which, the 2nd respondent vide letted dated 28.03.

2023 called upon the petitioner to attend the meeting to be held on 29.03.2023. Though, the petitioner had attended the said meeting and was assured that permission would be granted to operate the quarry for the nonoperative period, no further progress has been made till date. Hence, the petitioner has come up with the present Writ Petition.

Learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the respondents to permit the petitioner to operate the quarry for the non-operative operative period on the basis of this representation and pass appropriate orders on the same on merits and in accordance with law within the time that may be stipulated by this Court. 3/6

5. On the above contention, this Court heard the learned Additional Government Pleader appearing for the 1st respondent.

In view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the 2nd respondent to conclude the proceedings dated 29.03.2023 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and aggrieved persons if any, within a period of six (6) weeks from the date of receipt of a copy of this order.

7. Accordingly, the Writ Petitions are disposed of with the aforesaid direction. No Costs.
