ORDER
This writ petition has been filed, aggrieved by the order dated 08.06.2017 passed by the first respondent. Under the impugned order, the extent of land of the petitioner has been reduced pursuant to an application submitted by the fourth respondent.
2. According to the petitioner, he had purchased the property from his vendor as per the sale deed standing in the name of the vendor, which conveyed the correct extent of land. However, according to the petitioner, arbitrarily without giving notice to the petitioner, the impugned order dated 08.06.2017 came to be passed by the first respondent, reducing the land extent of the petitioner.
3. The petitioner has already given a representation to the second respondent on 19.12.2022, who is the appellate authority, challenging the impugned order dated 08.06.2017 passed by the first respondent.
4. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the official respondents and would also submit that pursuant to the said representation, Summons have also been issued to the petitioner to
participate in the proceedings. He would submit that if sufficient time is granted to the second respondent, the final orders will be passed in the petitioner's appeal dated 19.12.2022, after hearing the objections of the fourth respondent.
5. No prejudice would be caused to the official respondents if a direction is issued to the second respondent to dispose of the appeal filed by the petitioner, challenging the order dated 08.06.2017 passed by the first respondent within a time frame to be fixed by this Court after hearing the objections of the fourth respondent as well as the neighbouring land owners if any and any other third party whom the second respondent deems fit to enquire.
6. Since no adverse orders are passed against the fourth respondent, notice to the fourth respondent is dispensed with by this Court.
7. This Court is not expressing any opinion on the merits of the petitioner's appeal dated 19.12.2022.
8. For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 19.12.2022, which is treated as an appeal, by this Court within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the fourth respondent as well as the neighbouring
land owners if any and any other third party whom the second respondent deems fit to enquire.
