ORDER
(Order of the Court was made by the Hon'ble Chief Justice) We find that the petitioner's representation for re-classification of land was required to be decided by the District Revenue Officer, in view of G.O.Ms.No.385, dated 17.08.2004. Mention about the same has been made in our earlier order passed on 05.08.2025 in WP No.28752 of 2025.
2. However, it appears that the Tahsildar, Uthukuli Taluk, who was directed to complete the inquiry and forward records to the competent authority for taking a decision, has usurped the power to himself and passed the order.
3. Learned State Counsel would fairly submit that the Tahsildar could not have taken a decision in the matter but all that he was required was to forward the report to the District Revenue Officer.
4. In view of the submission so made, the order passed by the Tahsildar, impugned in this petition, is set aside. The District Revenue
Officer, Tiruppur District, is directed to take appropriate decision in the matter, based on the inquiry report prepared by the Tahsildar. The Tahsildar, Uthukuli Taluk is mandated to forward the report to the District Revenue Officer within three weeks from the date of receipt of a copy of this order, and a decision be taken by the District Revenue Officer, Tiruppur District, within four weeks thereafter.
