ORDER

This writ petition has been filed for a direction, directing the respondents 2 and 3 to pay the present salary, periodical increment, arrears payment and all other emoluments as per the existing 7th pay commission from the date of order of suspension.

2. The petitioner was selected as Assistant and subsequently, promoted to the post of Zonal Deputy Block Development Officer. While being so, the petitioner was arrested and remanded to judicial custody in pursuant to the registration of FIR in Crime No.16/2019 for the offences punishable under Section 409, 420, 468, 471 read with 120 B IPC. Now the charge sheet has been filed and taken cognizance in C.C.No.1664/2025 on the file of Judicial Magistrate-1, Vellore and it is pending for trial. The petitioner was also served with charge memo alleging that he had misappropriated to the tune of Rs.12,19,360/- and deposited 2/5

the said amount in his personal account from the month of March, 2013 to October, 2016. Now the enquiry is completed and about to pass final orders. In the meanwhile the petitioner was deemed to be placed under suspension by order dated 07.07.2017. However, in the light of the Government Order in G.O.Ms.No.81 Human Resources Management (N) Department dated 04.08.2022, the order of suspension was revoked and reinstated the petitioner into service. Now the petitioner sought for present salary, periodical increment, arrears payment and all other emoluments as per the existing 7th pay commission from the date of order of suspension.

In view of the above, the respondents 2 and 3 are directed to consider the representation dated 25.02.2025 submitted by the petitioner, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. The second respondent is directed to pass final orders in the disciplinary proceedings as against the petitioner, within a period of four weeks from the date of receipt of a copy of this order. 3/5
