: Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the respondents to pay the difference of leave surrender amount of Rs.2,21,274/-. D.A. Arrears of Rs.12,375/- and last 11 days salary of Rs.27,045/- by taking note of the 14th wage settlement signed under Section 12(3) of the I.D Act dated 24.08.2022 within the stipulated time fixed by this court.

COMMON ORDER These Writ Petition have been filed for direction, directing the respondents to pay the difference of, gratuity amount, leave surrender amount, surrender leave salary, D.A. Arrears, VRS amount, Medial leave surrender and last days salary of the petitioners respectively by taking note of the 14th wage settlement signed under Section 12(3) of the I.D Act dated 24.08.2022 within the stipulated time fixed by this court.

2. Heard the learned counsel for both sides and perused the materials available on record.

The petitioners were working as Selection Grade Conductor, Selection Grade Driver, Senior Grade Senior Driver, Senior Grade Senior Conductor, Checking Inspector, Senior Checking Inspector, in the respondent Corporation and retired from service on 31.05.2023, 25.03.2023, 30.06.2022, 30.06.2023, 30.04.2020, 05.07.2023 and 31.07.2023.

4. A settlement was entered into between the Union and the Management on 24.08.2022. But it was made applicable with effect from 01.09.2019. Therefore, the petitioners were also entitled to the benefit under the said settlement. But their 2/5

terminal benefits were settled without reference to the terms of the settlement. Therefore, the petitioners are entitled not only to the difference in benefits, but also interest thereon.

5. This stand of the petitioners cannot be disputed. Therefore, the respondent is directed to pay the petitioners the difference of gratuity amount, leave surrender amount, surrender leave salary, D.A. Arrears, VRS amount, Medial leave surrender and last days salary of the petitioners respectively by taking note of the 14th wage settlement signed under Section 12(3) of the I.D Act dated 24.08.2022 . Those amounts shall be paid within period of six weeks from the date of receipt of a copy of this order. The respondent has to make the differential payment with 6% interest per annum to be computed from the date of the petitioners' retirement till the date of payment.

6. With the above said observations, this Writ Petitions stand disposed of. No costs.
