O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 329(3), 296(b), 115(2), 118(1), 351(3) of BNS in Crime No.415 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that, the petitioner herein is the brother-in-law of the defacto complainant; that on account of family dispute, the petitioner went to the defacto complainant's house, abused the defacto complainant using filthy language and attacked him using wooden log, due to which the defacto complainant sustained injuries. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case; that on account of family dispute, the defacto complainant lodged a false complaint against the petitioner; that the injuries sustained is only simple injuries; and that the petitioner is ready to abide by any conditions that may be imposed by this 2/4

Court, hence sought for anticipatory bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner has five previous cases including one murder case; and that the investigation of this case is pending.

Considering the submissions made on both sides, facts and circumstances of this case, gravity of offence, the petitioner has bad antecedents including one murder case and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 25.11.2025 stn 3/4
