records and consequently direct the 2nd respondent to preserve, pave and restore the public road situated at Karnam Street Joint Road connecting the Karnam Street with the New Balaji Nagar 1st cut road and Ranganathan Street, Selaiyur, Chennai, based on the petitioner's representation dated 09.09.2025.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The allegation made through this public interest litigation is that the private respondent, while raising construction, has encroached upon public road. A complaint in this regard has been made to the Corporation authorities on 09.09.2025, copy of which has been placed on record.

2. Once such a complaint has been made, the Corporation authorities are obliged under the law to examine the complaint, make

a spot inspection, conduct survey and if any part of the public road is found encroached, to take immediate action against such encroacher. Let a survey be conducted, if not already conducted and if it is found that encroachment has been made by the third respondent, appropriate action should be taken at the earliest and preferably, within two months.
