Prayer in A.No.792 of 2026 : This application has been filed to pass an order accepting Special Power of Attorney Deed dated 19.12.2025 appointing the 6th applicant/petitioner's sister Sumathi, the 7th applicant/petitioner herein to represent the 6th applicant/petitioner in executing the bond for a sum of Rs.25,000/- in favour of Assistant Registrar,(O.S.II), lHigh Court, Madras as per the order of this Court dated 27.10.2025. COMMON ORDER Heard.

These applications have been filed in relation to the order passed in O.P.No.738 of 2024, whereby Letters of Administration with Will annexed were ordered to be issued in favour of petitioners 2 to 13, subject to each of them executing a security bond for a sum of Rs.25,000/- in favour of the Assistant Registrar (O.S.II), High Court, Madras. In A.No.6077 of 2026 the petitioner seeks permission to permit the 7th petitioner to execute the security bond on behalf of the 6th petitioner also, and in A.No.792 of 2026 the applicant seeks acceptance of the Special Power of Attorney Deed dated 19.12.2025 executed by the 6th petitioner in favour of the 7th petitioner for the said purpose.

The affidavit filed in support of the applications states that the 6th petitioner is suffering from chronic kidney failure, is undergoing dialysis and continuous medical treatment, and has been medically advised to avoid travel, physical strain and outside exposure. It is further stated that the 7th petitioner, who is his sister, is fully aware of the facts and has been authorised under the Special Power of Attorney Deed dated 19.12.2025 to represent him for execution of the security bond.

4. Learned counsel for the petitioners submitted that, in view of the medical condition of the 6th petitioner, he is unable to appear in person for

execution of the security bond and therefore, the Special Power of Attorney may be accepted and the 7th petitioner may be permitted to execute the bond on his behalf also.

5. No objection is stated on the side of the respondents.

6. Having regard to the averments contained in the affidavits, particularly the medical condition of the 6th petitioner , and in view of the fact that no objection is raised by the respondents, this Court is satisfied that both the applications can be allowed.

7. Accordingly, these applications are allowed. The Special Power of Attorney Deed dated 19.12.2025 executed by the 6th petitioner in favour of the 7th petitioner is accepted for the limited purpose of compliance with the order dated 27.10.2025 made in O.P.No.738 of 2024. The 7th petitioner is permitted to execute the security bond for herself and also on behalf of the 6th petitioner, in favour of the Assistant Registrar (O.S.II), High Court, Madras, subject to compliance with the usual Office formalities.

8. No costs.
