Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondents to consider the petitioner's representations dated 30.09.2025 and 27.10.2025 to refer the petitioner's claim for enhancement of compensation to the jurisdictional competent authority / referring authority.

ORDER

After submitting representations dated 30.09.2025 and 27.10.2025 for reference of the petitioner's claim for enhanced compensation to the jurisdictional Reference Court, the present writ petition has been filed.

2. Learned counsel for the petitioner has placed on record a notice dated 24.11.2025 informing the petitioner that compensation has been determined in a sum of Rs.1855.93 per sq.mtr. Therefore, learned counsel submits that the petitioner's request seeking reference is within the time limit prescribed under the Tamil Nadu Highways Act, 2001.

3. Mr.P.Sathish, learned Additional Government Pleader, takes notice for all the respondents. He submits that the reference would be made within four weeks from the date of receipt of a copy of the order in this writ petition.

4. The petitioner has been informed about the fixation of compensation under communication dated 24.11.2025. Therefore, the petition is within the 60 day time limit prescribed for seeking a reference in relation to enhanced compensation. Consequently, this writ petition is disposed of by directing the District Collector, Thiruvannamalai to consider the petitioner's request for a reference to the Reference Court and pass necessary orders thereon within four weeks from the date of receipt of a copy of this order. There will be no order as to costs.
