ORDER
This Civil Revision Petition has been filed challenging the impugned docket order, dated 12.11.2025 passed by the Principal Commercial Court, Chennai in C.O.S.No.375 of 2025.
2. The impugned docket order, dated 12.11.2025 reads as follows :- "Both side counsels present. Memo filed to refer to Mediation. Hence this suit is referred to Mediation call on 12.12.2025."
3. The contention of the petitioner before this Court in this revision is that the 1st respondent having not instituted pre-suit mediation, the impugned order passed by the commercial court is erroneous and not in accordance with law. The learned counsel for the petitioner, on instructions, would also submit that the petitioner is not willing to go for mediation as per the impugned order. On the other hand, the learned Page No.2 of 4
counsel for the 1st respondent/plaintiff is willing to go for mediation as per the impugned order.
4. Since the petitioner is not willing to go for mediation as per the impugned order, this Civil Revision Petition is disposed of by directing the trial court to dispose of the suit in C.O.S.No.375 of 2025, on merits and in accordance with law, as expeditiously as possible. This Court is not expressing any opinion on the merits of the maintainability of the suit in C.O.S.No.375 of 2025 in this revision. The interim stay already granted by this Court shall stand vacated. No costs. Consequently, the connected miscellaneous petition is closed.
