ORDER

This Writ Petition has been filed by the petitioner seeking for a Writ of Mandamus, to direct the respondents to refund Rs.50,00,000/- payable to the petitioner towards refundable security deposit.

2. Mr.D.R.Arun Kumar, learned Standing Counsel, accepts notice on behalf of the respondents. With the consent of the learned counsel appearing for the parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

3. The petitioner made an application to the respondents for establishment of 10 MW Solar Power Plant as per TNERC's Solar Order No.5 of 2018 dated 28.03.2018 and the petitioner has paid a sum of Rs.50,00,000/- on 08.08.2023 towards 50% of the refundabel security deposit. Subsequently, due to administrative reasons the petitioner vide application dated 03.12.2024 requested the 2nd respondent to name transfer the above project to namely M/s.Vanessa Infra Developers Pvt. Ltd., and the same was approved by the 2nd Repondent. The 2nd repondent has also informed to M/s.Vanessa Infra

Developers Pvt Ltd., to pay applicable charges including refundable security deposit. In view of the transfer of the project, the petitioner has been claiming refund of the refundable security deposit of Rs.50,00,000/- by way of representation dated 24.03.2025. Since the same was not considered, the petitioner has filed this writ petition before this Court for appropriate orders. 4.Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioner submits that, if would suffice, if this Court issues a direction to the 2nd respondent to refund Rs.50,00,000/- payable to the petitioner towards refundable security deposit by considering the petitioner's rerepsentation dated 24.03.2025, within a time frame that may be fixed by this Court.

5.In view of the limited request sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion of the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 24.03.2025, on merits and in accordance with law and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner and aggrieved party, if any.

6. With the above direction, this Writ Petition is disposed of. No costs.
