ORDER
This writ petition has been filed seeking a direction to the respondents to consider the petitioner's representation and sanction the education loan for the 3rd year.
2. The case of the petitioner is that his daughter, who is studying MBBS, was sanctioned educational loan of Rs.4,00,000/- on a yearly basis for first two years. The first respondent bank paid the loan amount directly to the college for the first two years. However, when the third year fees were sought to be released, the first respondent directed the petitioner to approach the second respondent. The second respondent, in turn, orally informed that only upon payment of interest of Rs.37,000/- by the petitioner for the previous two years, the third year loan would be released. Hence, the petitioner has submitted a representation dated 30.10.2025, but no action has been taken so far. Hence, present writ petition.
3. Heard both sides and perused materials placed on record.
4. Admittedly, the educational loan was sanctioned to the petitioner's daughter and the loan for the first two years has already been released by the first respondent. Now, the first respondent has directed petitioner to approach the second respondent for the release of the third year loan. It is the case of the petitioner that the second respondent is insisting on the payment of interest for the amount already released. Since the amount has not been released, the petitioner's daughter is facing serious difficulty in pursuing her third year MBBS Course.
5. As the petitioner has already given a representation, the first respondent is directed to consider the same. In the event any interest is payable under the terms of the contract, the second respondent is at liberty to collect the said amount and process the payment legally. The petitioner shall pay the interest amount, if any, as per the contract. Upon such payment, the third year loan amount shall be released without any further delay.
