Magistrate No.II, Tiruppur, in Crl.M.P.No.2813 of 2023 in C.C.No.17 of 2022, the petitioner/third accused preferred this Criminal Revision Petition.

2. Before the trial court, the petitioner/A3 filed a petition under Sec.250 of B.N.S.S. seeking to discharge him from the proceedings stating that he was not a signatory of the sale deed said to be purchased by the defacto complainant and he has been falsely implicated in this case, even otherwise, as per the order passed by the Government acquiring the property under Sec.37-A of Tamil Nadu Land Reforms (Fixation of Ceiling on Land) Act,1961. Hence, he had filed the petition and the same was dismissed by the trial judge on hearing both sides, holding that already there was a direction issued to conclude the trial by this court in Crl.R.C.No.1577 of 2025 and thereafter, with the help of another accused, he preferred the said petition. Therefore, it was dismissed. Aggrieved over that, the petitioner/A3 preferred this Criminal Revision Case.

3. The learned counsel for 1 st respondent/defacto complainant submitted __________Page 3 of 6

that already the same set of relief was sought before the trial court, but it was not accepted. Against which, he had preferred a Criminal Revision Case in Crl.R.C.No.1577 of 2025, wherein this court also held that the reasons assigned to discharge him from the proceedings as such is not sustainable one and issued a direction to the trial court to conclude the trial within a period of six months and thereafter, with the help of another accused, he filed the said petition as such is not maintainable.

4. The learned counsel for petitioner would submit that the reason assigned to discharge him from the proceedings is totally different from the other accused. According to him, he is not a signatory of the sale deed, even otherwise, the law permit him to sell the property and there is no offence committed by him.

5. Admittedly, on the date of alleged sale, he was also one of the Director __________Page 4 of 6

of A1 company and the entire amount was received by A1 company. So, he is also entitled to avail lawful benefits from it. Therefore, he is not entitled to sell the property and same cannot be decided now, it can be decided only at the time of trial. Therefore, the findings rendered by the Judicial Magistrate No.II, Tiruppur is confirmed and this Criminal Revision Case is dismissed.
