ORDER

When the matter was taken up, the learned Government Advocate (Criminal Side) appearing for the respondent submitted that the trial has commenced, P.W.1 was examined on 25.08.2023 and the case now stands posted for examination of P.W.2 on 18.12.2025.

2. Though several legal grounds have been raised by the learned counsel for the petitioners, this court is not inclined to quash the impugned proceedings at this stage.

3. At this juncture, learned counsel for the petitioners seeks permission of this court to raise all the grounds raised in this petition before the trial court. However, he would request that the presence of the 2nd petitioner in connection with SPL.C.C.No.1 of 2023 on the file of 1st Additional District and Sessions Court, Tiruvallur, may be dispensed with.

4. Taking into consideration the above submissions, the petitioners are at liberty to raise all the grounds raised in this petition before the trial court. The presence of the 2nd petitioner before the trial court is dispensed with on condition that he shall be duly represented by his counsel on all hearing dates 2 / 4

and the petitioners shall cooperate for the speedy disposal of the trial. The 2nd petitioner shall appear before the trial court whenever the trial court insists for his appearance and at the time of receipt of copies, answering the charges, questioning under Section 313 Cr.P.C., passing of judgment or any other date as may be required by the trial court.

5. With the above observation, this criminal original petition is dismissed.
