ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing respondents 1 to 3 to take appropriate action against the 13th respondent and to cancel Patta Nos. 3737 and 3789, by considering the representations dated 26.08.2021 and 25.08.2025 submitted by the petitioner.
2. According to the petitioner, representations were submitted to the official respondents seeking cancellation of Patta Nos. 3737 and 3789 issued in favour of the 13th respondent. The petitioner contends that though an enquiry was initiated, no final order has been passed thereon till date.
3. The learned Government Counsel would submit that no enquiry has been conducted so far. He requests a period of twelve weeks' time to conduct an enquiry and pass appropriate orders on the petitioner's grievance.
4. The learned counsel appearing for the 13th respondent reiterates the contentions raised in the counter-affidavit and strongly objects to the cancellation of the patta. He further submits that the 13th respondent will duly participate in any enquiry conducted by the authorities and seeks liberty to file a detailed explanation/reply before the official respondents.
5. This Court finds force in the contentions raised by the learned counsel appearing on either side.

On a perusal of the records, it is seen that the petitioner's representations dated 26.08.2021 and 25.08.2025 seeking cancellation of the pattas issued in favour of the 13th respondent are still pending. It also appears that the Revenue Divisional Officer concerned, who is the competent statutory authority to consider the petitioner's grievance, has not been impleaded as a party to this Writ Petition.

Therefore, without going into the merits of the case, this Court directs the petitioner to submit a fresh representation to the competent Revenue Divisional Officer within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of such representation, the Revenue Divisional Officer concerned shall consider and dispose of the same, on merits and in accordance with law, after affording a fair opportunity of hearing to the petitioner, the 13th respondent, and any other interested parties, within a period of twelve (12) weeks thereafter. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 10-06-2026 Asi
