No.36973/91/LA dated 13.11.1991 and LPR CPN. 1294/91 vide Na.Ka. No.511/91 dated 16.11.1991 in the plots situated at GHUGAN GARDEN comprised in Survey Nos.514/1B1, 515/1 and S.F.No.514/2B, 515/2B and 516/4B in Vadavalli Village, Perur Taluk, Coimbatore District.

ORDER
This writ petition filed by an association espousing the cause of its members is not maintainable.
2. According to the petitioner association, despite the layout in question being an approved one, the plan sanction application sought for by individual plot owners is being rejected by the respondents. Aggrieved by the same, the petitioner has filed the writ of mandamus to direct the respondents 4 and 5 to accept the application submitted by the residents/members of the petitioner association seeking for building plan approval.
3. Only individual plot owners, who are aggrieved by the non-acceptance of their application seeking for building plan approval, can approach this Court individually by filing separate writ petitions. In the instant writ petition, no particulars have been given with regard to the details of the individual applications submitted by the individual plot owners seeking for building plan approval.
4. After giving due consideration to the aforesaid factors, this Court expressed its view that this writ petition is not maintainable, as it is filed by an association. In view of the said view expressed by this Court, the learned counsel for the petitioner has now made an endorsement in the court bundle seeking liberty for filing a separate writ petition by the individual plot owners for the very same relief as prayed for in this writ petition. Accordingly, in terms of the endorsement made by the learned counsel for the petitioner, this writ petition is disposed of as withdrawn by granting liberty as prayed for. No Costs.
