ORDER

(Order of the Court was made by C.Kumarappan J.) The present writ petition has been filed to direct the respondents 1 and 2 to remove the encroachments made by the 4th respondent in Government promboke land in S.F.No.668/1 and S.F.No.668/5 in Sunchalnatham Village of Pennagaram Taluk in Dharmapuri District.

When the matter is taken up for hearing, the learned Additional Government Pleader would submit that on field verification and survey, they found that the 4th respondent has encroached upon above land and they are under the process of issuing notice Sections 7 & 6 of 1905 Act, and requires eight weeks time to complete the eviction process. For ready reference, it is appropriate to extract para Nos. 7 to 9 of the counter affidavit, which reads as under:

7. I humbly submit that during the field inspection, it was found that the Respondent No.4 has encroached upon the Survey No.668/5 in its entirety to its full extent and has also made encroachments in Survey No.668/1 an extent of

0.32.80 Hectares of Lands classified as Government Poramboke - Anadheenam by way of cultivation of seasonal crops.

8. I submit that the Respondent No.4 despite holding patta lands to her name has encroached upon the Subject Lands. I submit that during the field enquiry it was further found that the Respondent No.4 has unlawfully erected fencing for a government land and has been threatening the common people trying to cross the empty lands encroached by her.

I humbly submit that after the field inspection, steps are being taken to take action under the Tamil Nadu Land Encroachment Act 1905 under Section 7 and 6 to evict the respondent No.4 from the Survey No.668/1 and Survey No.668/5 of the Sunjalnatham Revenue Village in the Pennagaram Taluk in the Dharmapuri District in accordance with the procedures of the Act and same would be completed within a period of 8 weeks.

3. In view of the above submission, we deem it appropriate to direct the respondents 1 and 2 to remove the encroachments by following all due process of law within a period of eight weeks from the date of receipt of a copy of this order.
