ORDER
The petitioner, who were arrested and remanded to judicial custody on 09.10.2025 for the offences punishable under Sections123 of BNS, r/w 22(a) of COTPA Act, in Crime No.623 of 2025, registered on the file of the respondent police, seeks bail.
2. The allegation against this petitioner is that, this petitioner was found in possession of 4.5 kgs of banned tobacco products. Hence this case.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner is in judicial custody since 09.10.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioners was found in possession of 4.5 kgs of Ganja and the petitioner is a habitual offender and also having three any previous cases similar in nature, if the petitioner 2/5
released on bail he will indulge in similar activities and opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case, that the petitioner is having bad antecedents and also having any three previous cases similar in nature, if the petitioner granted bail he will indulge in similar offences, this Court is not inclined to grant bail to the petitioner with certain conditions.
