ORDER
1. Heard.
2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of the matrimonial Original Petition in HMOP No.293 of 2025, now pending on the file of the Principal Subordinate Court, Tiruchengode, Namakkal District and to transfer the same to the file of the Family Court, Chennai.
3. The marriage between the petitioner and the respondent was solemnized on 05.09.2016 at Arulmigu Mahalakshmi Samedha Vaikunta Venkatesa Perumal Temple in Tiruchengode as per Hindu rites and customs. The respondent/husband filed HMOP No.239 of 2025 seeking dissolution of marriage before the Principal Sub Court, Tiruchengode.
4. It is the case of the petitioner/wife that the petitioner is residing in Chennai. It is further stated that the petitioner has to take care of a six years old son, who is presently living with her mother, and that it would
be difficult for the petitioner to undertake travel and attend the proceedings at the place where the Original Petition is pending.
5. Though notice was ordered on 28.11.2025, today, when the matter is taken up for hearing, there is no representation for the respondent.

Having considered the submissions and the circumstances pleaded, and bearing in mind the settled principle that, in transfer of matrimonial proceedings, the convenience of the wife ordinarily deserves primacy, this Court is of the view that the petitioner has made out sufficient grounds for transfer.
7. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. The proceedings in HMOP No.293 of 2025, pending on the file of the Principal Subordinate Court, Tiruchengode, Namakkal District, shall stand withdrawn and transferred to the file of the Family Court, Chennai. The learned Principal Subordinate Judge, Tiruchengode, is directed to transmit the entire records to the Family Court, Chennai, within three weeks from the date of receipt of a copy of this order and the Family
Court Chennai shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim order granted by this Court on 28.11.2025 shall stand vacated and C.M.P.No.29673 of 2025 is closed. There shall be no order as to costs.
