ORDER

The petitioner, who were arrested and remanded to judicial custody on 12.11.2025 for the offences punishable under Sections 24(1) of COTPA Act, 2003, 123, 275 of BNS, in Crime No.447 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner is ranked as A2 and he was found in possession of 80 kgs of banned tobacco products. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner is in judicial custody since 12.11.2025; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that totally 2 accused in this case, both were arrested, this petitioner is in custody and property recovered, 2/5

the petitioner is having one previous case similar in nature, the investigation is pending in this case and opposed for grant of bail to the petitioner.

Considering the facts and circumstances of the case, that the petitioner is arrested only on 12.11.2025 with the possession of 80 kgs of banned tobacco products and the petitioner is having bad antecedents and also having any one previous case similar in nature, if the petitioner granted bail he will indulge in similar offences, this Court is not inclined to grant bail to the petitioner with certain conditions.
