ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.09.2025 for the alleged offences punishable under Sections 309(6) of BNS in Crime No. 486 of 2025 on the file of the respondent police, seeks bail.

The allegation against the petitioner is that the petitioner joined hands with other accused to enter into the house of the de-facto complainant at night hours on 03.09.2025, attacked the injured lady by stick and also taken away cash of Rs.20,000/- and also snatched away weighing 1 1⁄2 sovereigns of Thali Chain & cellphone and fled. Immediately, the injured contacted her neighbours and thereafter, one of the well-wishers lodged a complaint. The petitioner was arrested on 04.09.2025.

The learned Counsel for the petitioner submits that the petitioner is ranked as A3 in this case and the properties have also recovered and the petitioner was arrested and remanded to judicial custody from 04.09.2025. However, the petitioner is ready to abide by any conditions imposed by this Court. He prays bail to the petitioner.

4.Per contra, the learned Government Advocate [Criminal Side] appearing for the respondent police reiterated the prosecution case and submits that the petitioner is bad antecedent and the petitioner is having six previous cases and investigation is pending in this case. Hence, he opposed for grant bail to the petitioner.

Considering the fact that this case is of mid-night robbery and attacked the injured and taken away the properties of the de-facto complainant and also considering the fact that the petitioner is having six previous cases, and if the bail is granted to the petitioner he would indulge in similar offences in future, this Court is not inclined to grant bail to the petitioner.
