O R D E R
The present Criminal Original Petition has been filed seeking to transfer the investigation from the file of the third respondent to the file of another agency.
The case of the petitioner is that on 07.11.2025, around 6.00 p.m., when the petitioner's wife was walking near the alleged building, a huge pipe fell on her from the building, as a result of which she sustained multiple fractures and grievous injuries in her leg. Therefore, the petitioner has lodged a complaint seeking action against the persons whose negligence caused the accident. However, based on the said complaint, a case in Crime No.294 of 2025 was registered by the third respondent Police for the offence under Section 125(b) of the BNS as a minor bailable offence for extraneous reasons. Therefore, alleging that the investigation has not been conducted in a proper manner, the present petition has been filed. Learned Government Advocate (Criminal Side) submitted that even as per the petitioner's contention, the accident occurred on account of the negligence of the building owners who were carrying out renovation work of the building. He further submitted that based on the 2/5
complaint given by the petitioner, a case in Crime No.294 of 2025 was registered by the third respondent for the offence under the relevant provision viz., Section 125(b) of the BNS. The respondent Police are proceeding with the investigation in a proper manner and he denied that the investigation was influenced by extraneous reasons. He also submitted that the plumber and the supervisor of the building have been arrested and later released on bail. He further submitted that the wound certificate is awaited. 4.
Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking into account the submissions made, this Court does not find any valid ground to transfer the investigation. However, the Assistant Commissioner of Police, Royapettah, is directed to monitor the investigation in Crime No.294 of 2025.

With the above observations, this Criminal Original Petition stands disposed of.
