This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 1066 days in filing the Criminal Revision Case against the order passed in C.A.No.3 of 2022 on the file of the learned III Additional District Court, Kallakurichi, dated 19.02.2022 and S.T.C.No.111 of 2017 on the file of the learned Judicial Magistrate, Fast Track Court, Kallakurichi, dated 19.09.2022.

2. The learned counsel for the petitioner would submit that the parties have compromised the issue and have also filed a joint compromise memo dated 23.03.2026, duly signed by the learned counsel for the petitioner as well as the learned counsel for the respondents. It is the further submission of the learned counsel for the petitioner that the complainant/respondent has also filed an affidavit expressing consent for the compromise.

3. Having considered the submissions made by the learned counsel for the petitioner and upon perusing the affidavit filed in support of this petition, this Court is of the view that sufficient cause has been shown for condoning the delay.

4. In the result, this Criminal Miscellaneous Petition is allowed and the delay of 1066 days in filing the Criminal Revision Case is condoned.

5. The Registry is directed to number the Criminal Revision Case, if it is otherwise in order, and list the matter for hearing on 24.03.2026. 23.03.2026 skr
