ORDER
The petitioner, who was arrested and remanded to judicial custody on 06.11.2025, for the offences punishable under Section 79 of BNS and 67A of IT Act in Crime No. 68 of 2025 registered on the file respondent police, seeks bail.
2. The allegation against the petitioner is that on 25.10.2025, the petitioner released YouTube video making certain abusive statement against various personalities including the officials and also the political leaders. Hence, he was arrested by the respondent police on 06.11.2025. Hence the complaint.
3. The learned counsel for the petitioner submits that though it is stated that the petitioner has not created any new video and uploaded in YouTube. He collated the videos of various persons and uploaded. He further submits that he has been falsely implicated in this case. He further 2/7
submits that the petitioner is in judicial custody from 03.11.2025. He further submitted that the petitioner is ready to abide any condition imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that in the YouTube video uploaded by the petitioner, there are severe abusive defamatory statements have been made by the petitioner herein. He further submits that he was arrested and remanded into judicial custody on 06.11.2025. He further submits that if bail is granted to the petitioner, there is every possibility that he would indulge in similar type of various activities in future. However, he opposed for grant of bail to the petitioner.
5. Considering the submissions made by the learned Counsel on either side and perused the records. On perusal of records, it reveals that certain defamatory and abusive information have been uploaded and though it is a 3/7
prima facie case has established that certain abusive materials have been uploaded.
6.Considering the facts and circumstances of the case, that the period of incarceration undergone by the petitioner; that the petitioner has no previous antecedents; this Court is inclined to grant bail to the petitioner with certain conditions.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned XI Metropolitan Magistrate Court, Saidapet, Chennai-15, and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 4/7
2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the respondent police station everyday at 10:30 a.m., for a period of three weeks and thereafter, as and when required for interrogation;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
